SummaryUnder general supervision, the Right-of-Way Agent (advanced level) performs professional and technical work supporting the County's Planning & Development review process. The position is responsible for reviewing development applications, subdivision plats, engineering plans, legal descriptions, easements, and right-of-way dedications to ensure compliance with the Adams County Development Standards and Regulations and applicable federal, state, and local requirements.

The position serves as a technical resource on right-of-way, property ownership, land records, legal descriptions, and easement matters related to land development. Responsibilities include researching property information, reviewing title documents and development plans, preparing and processing legal documents associated with dedications and vacations, coordinating with internal departments and external stakeholders, and providing guidance to County staff, developers, consultants, and the public throughout the development review process.

While the position may occasionally assist with property conveyances or other real property transactions, its primary focus is the administration and review of right-of-way and easement requirements associated with land development. Examples of duties
  • Independently review complex development applications, subdivision plats, engineering plans, vacation plats, and building permits involving right-of-way, easement, title, or property ownership issues.
  • Evaluate title commitments, legal descriptions, surveys, engineering plans, and supporting documentation to determine required dedications, easements, and property interests.
  • Serve as the technical resource for complex right-of-way, title, legal description, and property ownership issues associated with development review.
  • Confer with developers, property owners, attorneys, engineers, surveyors, utility providers, consultants, and public agencies regarding development requirements and right-of-way matters.
  • Coordinate with Planning & Development, Public Works, Engineering, Survey, Legal, and outside agencies to resolve property and development review issues.
  • Prepare and present technical recommendations, staff reports, resolutions, and agenda materials to County leadership, the Planning Commission, and Board of County Commissioners.
  • Provide technical guidance to staff regarding right-of-way administration, development regulations, title research, and legal documentation.
  • Represent the County during public meetings, administrative hearings, and discussions involving development-related right-of-way matters.
  • Recommend updates to County procedures, standards, and practices related to right-of-way administration and development review.
  • Perform other related duties as assigned.
Qualifications
  • Ability to determine status of existing right-of-way and easement agreements. 
  • Ability to prepare legal documents relating to ROW conveyances and easements. 
  • Independently research the records of Clerk and Recorder's Office for property descriptions, ownerships, and deeds. 
  • Understand and apply information presented in title policies and title commitments to development properties and applications. 
  • Familiarity with applicable Colorado laws related to the practice of land surveying and the division of or the development of property. 
  • Read and interpret plats, maps, surveys, and legal descriptions of property, plot plans and profiles. 
  • Ability to read and interpret legal descriptions in conformance with standard practice. 
  • Researching, analyzing, and interpreting moderately complex development regulations and land use data. 
  • Perform moderately difficult mathematical computations. 
  • Keep records and prepare clear, concise and complete written and oral reports. 
  • Interpret and apply federal, state and local policies, procedures, laws and regulations. Ability to establish, maintain, and foster positive and harmonious working relationships with those contacted in the course of work. 
  • Familiarity with computer software programs such as Microsoft Office products. Communicate clearly and concisely, both orally and in writing.? 
Supplemental informationExperience: Four (4) years of progressively responsible right-of-way or related experience, including property acquisition, title research, legal document preparation, real estate appraisal, engineering plan review, technical report writing, or similar work.
Education and Training::
  • High school diploma or GED required.
  • Supplemental training or coursework in real estate law, engineering, surveying, or a related field is preferred.
  • A bachelor's degree may substitute for up to four (4) years of the required experience on a year-for-year basis.
Certification:
  • International Right of Way Association (IRWA) Right-of-Way Agent certification, or higher, is preferred at hire and may be required within 18 months of employment.
Licenses: Possession of, or ability to obtain, a valid driver's license. 
Background Check: Must successfully pass a criminal background check.
Other Requirements:
  • Ability to travel throughout the County.
  • Ability to work in a standard office environment.
  • Ability to research property ownership and related records.
  • Knowledge of the Public Land Survey System (PLSS) and land boundary principles.
